This is the first in a series to discuss my Constitutional Property Rights Minarchist philosophy. I will take a look at each element individually before putting it all together. I figured I would start off with the nature of rights because that takes two of the CPRM parts off the table at once. This is because all rights are derived from property rights, which I aim to show through this thesis.
So, what exactly is a right? Is a property right different than a human right? Is the right to keep and bear arms different than the right to free speech? Where do rights come from anyway? I bet they were just made up by some old dead white guy, so they don’t matter. Most of what I’m about to say is probably old hat to most of the readers, but I decided to lay it all out just to make sure before I get to the big picture.
One note on rights off the bat (I like to reference pop culture) my favorite quote on rights actually comes from the band Powerman 5000 in their song ‘Free‘.

A right is something you have regardless of where or when are born. To hit on the points above, it is a human right. Just by being human these are the rights you posses (why they’re limited to humans will be addressed later on). Well, if it doesn’t matter where or when you are born, then that means certain things can’t be rights. A person born where there is no water can not have a right to it, otherwise that ruins the whole idea that it is inherent in being human, unless you wish to posit people born in a desert are not human, but that would be awfully racist of you. For shame. I think you need counseling to deal with your racism. But you aren’t important, the idea is. So I digress. What other things can a human be born without that some call rights? Well the big one today is healthcare. But that is an even more resource intensive thing than water, I mean we could all spare some water, but there are only a limited few to provide healthcare. That would mean that to provide healthcare to masses would be to compel certain people to provide it. Another thing, which is written into the South African Constitution, is housing. Well, if you have a right to housing, that is also something someone else must be compelled to provide. I keep coming back to that word, don’t I. Compelled. It sounds so innocent. But what does that really mean? Let’s check Dictionary.com

So to go back to the beginning. Yes it is the old ‘private island’ thought experiment, but with a small change. It’s not an Island, but any place on earth where the first humans were the first intelligent beings to move to (that intelligent beings bit will come back on my promise of why they are human rights). Ug shows up with his sharp stick and his loin cloth in lower Mongolia. When he gets there what does he own? Well, of course he owns his own body, he is a slave to no man, and ownership of everything else extends from his self ownership. And that sharp stick, he found it and chewed it for miles to sharpen it. The loin cloth, well he stole that, so that’s a bit more complicated on the ownership front. So he arrives in lower Mongolia and there is nothing there. There is like this one pissed off falcon circling overhead and Ug saw some wild dogs a hundred miles ago. But that’s it. So Ug decides he’s tired of roaming sits his ass down and says ‘shit, fuck this Ug build himself house!’ There aren’t many trees around, but Ug finds enough to build a frame for a rough stone age yurt. He then hunts enough animals and tans enough leather to to finish his new domicile. Ug found some wild grains and harvested the seeds, carefully planting them and tending to his new garden. Then a wild goat shows up, he grabs it and builds a nice pen. The goat provides him with milk to make up for the absence of an accessible source of water. Months pass and Ug has made a nice little home for himself. Then that asshole Ur shows up.

And that is the right to contract. Ug created things that were not there when he arrived, and owned those as well as himself. Ur owned a rock which Ug wanted, so they traded. I know this is all farcical, but these are the underpinning ideas. You own your own body. You own the fruits of your labor, which you may trade for payment (today we call this going to work). But you know who doesn’t have any rights? Animals. You know why? It’s not because I’m racist against animals, believe me I have lots of animal friends. No, it’s because animals don’t understand rights. That is an important concept. To you this whole diatribe while slanted and farcical, is something you can understand. If I tell you this is mine and that is yours, that is a concept a human can grasp by the age of three. If you try telling that to a 100 year old tortoise it will still just eat your lettuce and shit on your floor. Tortoises are assholes.

On days when I feel particularly cynical, I think there are no rights — there is only violence and the threat of violence.
Then, the non-aggression principle is just the choice to not threaten violence to get what you want.
Your cynical self is right, the world has been and always will be ruled by force. The best case scenario is that enough people are willing to use force to keep themselves and others from using force barbarically.
Rights don’t cease to exist because they’ve been infringed anymore than they only exist because a government recognizes them. Morality starts from rights. Whether you call it the golden rule or the NAP it all boils down to 2 things self ownership and recognition of others self ownership. Rights are the lines that when crossed allow force to be used in response.
To be free you must persuade others to let you be free. The persuasion may be done through debate or self defense. Even if we form our own society on the ocean by seasteading, we have convince the rest of the world to let us be free.

This project is cursed. We got through Dev and QA with nary a hiccup, now for prod it’s been failure after delay after failure.

Normally, we see errors in the lower environment.

Tonight, a process that took two hours on the same server previously (this was a redo attempt after a rollback) was still going at the four hour mark, and would have pushed the whole thing into the wee hours of the morning.
My best guess is that the pipline for the NFS mount was more heavily used on thursday evenings than saturday mornings, and so there was an additional delay from that. But I’m only speculating.
I’m taking it more presonally because I’ve been lead on it and it’s a fairly sizable item.

I’ve run into an interesting mental deadlock. I’ve been the technicaly guy on this process before in other environments, so I know exactly what’s involved. The steps we got through were 99% waiting.
Since the actual manager is on vacation, I’ve been doing the manager role of coordinating and contacting various people for associated tasks.
If you look at the actual tasks performed, I did as much or more than the technical guy. But I keep feeling like I didn’t contribute because the only technical tasks I did were at the very end to verify everything was sane after we rolled back.
I spent 2 am to 4 am Wednesday night working due to a prod table not having stats that the same table in QA had.
Even the most basic select statement wouldn’t complete without them.

Every person’s mind, body and conscience arer their own property exclusively. If possession shows ownership you cannot possess something more completely that actually being that thing. No other person, owning their own mind, body and conscience can make a compelling case that they hold property rights on others aside from brute force – that is to violate those property rights. In this respect all are born equal. What logically flows from here are the right to use your property as you decide, own fruit of y our labor, defend your property, and a complete taboo on putting your hands on others property without permission.
Negative rights really are pretty simple.
Then why do so many people reject them, or worse, don’t understand them?
Is it because they simply believe things cannot be so simple?
I’ve always felt that if one accepts the axiom of self-ownership everything else can follow, but most people don’t accept that axiom.
Not accepting that axiom is the problem. The problem for them is that they cant make an actual case for rejecting it.
Their only option is to say that people dont own themselves. So, some people are born with something special that gives them property rights over others? Or they try to argue that some collective has property rights on its members. Guess what? Antebellum plantations were collectives. Anyway they go about it they end in the same place – we have a word for a system that makes a person the property of another: Slavery.
In my experience they usually say that no one rightfully owns anyone (including their own-selves(heh)).
The transition from there to governments is what always confuses me admittedly, just sounds like magic to me when it is described, or naked utilitarianism, depending on the explanation.

“Rights” are arbitrary, and only agreed on by a collective via some social construct. Citizens in the US have a “right” to keep and bear arms, as well as (we hope), certain immunities for free speech, due process, etc.
Other countries or cultures dont necessarily respect those.
Natural rights aren’t really all that arbitrary. You’re right that other cultures don’t respect them. You’re wrong that this somehow makes them arbitrary because if you go to those countries, you’ll find the exercise of those rights on a daily basis.
The right to bear arms enshrined in the Constitution is a manifestation of the right to self-defense. The gun is just a cultural tool. And if you don’t believe that self-defense is a right universally recognized, go to any country of your choosing and decide to strike someone walking down the street.
Private property is the most interesting example. Time and again groups try to restrict this, and no matter the cultural context we see pretty similar results.
Denying the existence of negative rights is akin to cultural relatavists who deny the superiority of Western science. We know there’s objective truth because of the results produced and what happens when we stray from those principles. These things aren’t arbitrary. The results of governments restricting them are on display irregardless of time and place. Their existence does not depend on a particular culture or society or group even believing in them.
But rights, like criminal sentencing guidelines, are only effective when everyone accepts them.

It could just be a taboo codified into law, and many societies in history didn’t exactly extend this right to everyone.
Could be, but when it is a ‘taboo’ shared by almost every culture, you have to question why it is taboo? What does that mean about us as humans? Can it be explained away? These are questions that need to and should be asked, but to deny the reality of the human condition on such a large scale does no one any good.
Personally I think it is because people typically form strong family bonds, and imbue bodies of loved ones with strong emotional attachment, such that disrespecting a person’s body, even after death, causes strong emotions in family members, resulting in tumult in society and would be a maladaption not to prohibit it.
Similar to taboos against cannibalism or necrophilia, which have good reasons to exist in that they prevent disease, besides the above.
But then you need to explain why people who aren’t related to the person, or ever knew them find it abysmal as well.
Probably not as abysmal as the family thinks it is.
I feel like we’ve gone off track on this one. I do more or less agree with your premise of self ownership, but you should think more about why animals don’t have rights, I don’t think the requirement to be capable (at some point? how can you be sure then, one way or another of the future) of understanding rights is particularly compelling, at least not without significantly more logical steps. Also babies.

I guess the more common counter argument here is that we all belong (in a literal sense) to humanity, based on everyone being owned by some common ancestor.

Why did the editors post this during my drinking time? Why!? It’s exactly as stated, as a human a child has the ability to comprehend such things, even if it is in the future. No amount of time or maturation will help any other species as a whole be able to grasp such a concept.

Because existence isn’t finite. The same argument could be made about sleeping people.
That isn’t clearly true. Based on life being kind of continuous through sleeping to waking, it is likely that sleeping people still understand rights, they may even be dreaming about rights. I think I’ll name this phenomenon Schrödinger’s rights – you can’t know if the person understands rights without waking them up, at which point you collapse the uncertainty.

I’m no philosopher. I just generally sum this up as negative rights are things that align with human nature. I know full well there are arguments ad nauseum that could be presented to try and undermine that claim. I could probably respond to most of them individually even if the simple claim presented here isn’t obviously all encompassing. But freedom of expression is something innate in human beings regardless of whether an individual articulates it in that way or even recognizes it. Just ask someone to shut-up as an individual and see what results you tend to get. People may go along with certain restrictions, but those restrictions are things designed to limit human nature (yes, there are impulses that are destructive and which aren’t recognized as rights).
The one I love is X civilization way back in history didn’t believe in property rights man! But, I bet if I had a time machine and could travel to anywhen and I stole someone’s shit I’d face some consequences.

Tangentially relevant. My daughter (9 y/o) is fascinated by princesses. If she mishaves, I ask her, “Do you think a princess would do that.” Finally, last week I asked her where all those pretty dresses come from that the princesses are wearing. “They make them for her.” You can guess where this conversation went. Eventually, she got to the conclusion after many questions: “It’s not right if they steal the money for the dresses.” Since she was 7, she’d point at posters of politicians of any party and say, “He’s a thief, too. Right, Papa?” Love that kid. My wife just eye rolls at us.
I’ve avoided pushing politics on any of my nieces or nephews. Except when my niece came home from school crying that the world was going to end because of global warming, then I kind of got political in explaining what was going on. Another niece is now into the they/them/their thing, I tried to politely explain to her that descriptors don’t matter, what matters is who you are. I think she gets it, but she’s still into that shit. She he is a high functioning aspie (for real) and these people are fucking with her head. Makes me almost want to go Warty Hugemen on these predators.
No offense, but “uncle” and “dad” are different. Your situation is most likely different and so no judgment on you. My sister raised 3 fucked up kids that are nasty little SJWs. Best I can do is to hope they recognize the concept of “bad example is still an example” and apply it to their mom. I’ve been a third parent to all my nieces and nephews, been the one to pottytrain, the one to teach, the one to punish. People say all the time ‘You don’t know what it’s like to be a parent’ because I have no kids of my own, but I’ve been raising kids since I was 13. It’s the parents that always fuck them up.
You’re going above and beyond the call of duty and I respect that. A functional nuclear family, however, is statistically the best environment for a kid. That it’s being degraded by the progressives is what bugs me.
Oh, I know. That’s been my dating dilemma for the last few years. I’ll say it because I think I already said it here in an article. I’m celibate until marriage. You know how hard it is to find a 35 year old woman in these parts that isn’t a divorce with four kids? And the older I get the gap between me and any woman who not only doesn’t hold that same value but doesn’t even have kids gets farther and father away.
It was frog in boiling water for me. I didn’t notice how fucked up the American family had become until I GTFO. The average family here (very low divorce rate) would be exemplary in the states. Gotta say that lately my anger at the destruction of the US family is giving way to resigned sadness.
I’m not religious, but I have always planned to be celibate until marriage. I’m 23 and trying to socialize more on campus so I can have more dating opportunities.
My mom wasn’t a divorcee with four kids until she was 36. There’s still hope.
Of course, my stepfather had two kids of his own when they met but they still had ~25 great years together once we all aged out of the house.
I don’t get the celibacy thing before marriage, but if that’s what you guys want/need to be happy, knock yourself out. Not saying being a slut is good, either.
The aspie niece I was speaking of doesn’t know her dad, I’m not even sure if she knows of him. I never pried that fat into what her mom told her. My sister and her daughter lived with my parents when I had to move back and take care of my ailing father, one of the reasons why I give an automatic ‘fuck you’ to people who say I don’t know about raising kids. That’s the color scheme for the lesser half of the chapter – the ‘Primaris’ marines. The real marines wear gray and red. The turret gunner is in techmarine red because that’s what vehicle operators are in. Like Maximus here (I’ve since found the missing storm bolter that made me have to get creative in arming that rhino, but I prefer the version with more character.)

The list had only been live for 12 hours when word reached Donegan that Buzzfeed were preparing to publish a story about it. She immediately closed it down.
